Can I Get A Felony Conviction Expunged?

In certain situations you can get a felony conviction erased from your record in North Carolina.

How do you go about getting a felony conviction expunged from your record?

Well, there are two main ways the law allows someone to expunge a felony.

 

The first main way the law allows someone to expunge a felony is when the person asking for the expunction was under 18 at the time they committed the felony.

 

The second main way the law allows someone to expunge a felony is when the person asking for the expunction was 18 or older at the time they committed the felony.

 

If you want to expunge a felony conviction you committed when you were under 18 then you may be entitled to get your felony conviction erased if:

  1. The felony you want expunged is a “nonviolent” felony.
  2. You have no other misdemeanor or felony convictions on your record.
  3. You’ve waited at least 4 years since the end of your sentence for the felony.
  4. You’ve performed 100 hours of community service.

 

If you want to expunge a felony conviction you committed when you were 18 or older then you may be entitled to get your felony conviction erased if:

  1. The felony you want expunged is a “nonviolent” felony.
  2. You have no other misdemeanor or felony convictions on your record.
  3. You’ve waited at least 15 years since the end of your sentence for the felony.

 

On top of meeting those qualifications listed above you also must get sworn statements of your good character to support your application for expunction.
